Since 1 June 2011 the compulsory registration of title (legal ownership of property) was extended to all counties of Ireland. The office responsible for holding public records of land ownership is the Property Registration Authority and solicitors for the purchasers must apply for first registration of the title in the Land Registry in accordance with Property Registration Authority rules. The impact on vendors is that if the property they are selling is unregistered, then they will need to have a Land Registry Compliant Map in place when contracts are being issued

Prior to conducting a survey of the property we will request any maps held on file with the title.

We will then schedule a survey to access the property. For terraced, semi detached & detached properties we do not need to enter into the house so long as we can have unhindered access to the front and rear of the property.

For apartment/duplex properties with another unit either above or below, we will need internal access to the property for measurement and floor plan preparation purposes. If car parking spaces are owned by the property they will need to be mapped. Assigned car parking spaces do not need to be mapped.

In addition to measuring the site during the survey we will compare the current on site condition with the historical record maps and reconcile the historical maps with the current Ordnance Survey Ireland records.

More often than not it will be necessary for us to consult with your solicitor to clarify the extent of the property ownership and any rights of way that also need to be mapped.

As soon as we have clarified any points observed during the survey we will produce the Land Registry Compliant map and email a scanned version to you or your solicitor.

The prepared map which will signed and certified by us  (backed by professional Indemnity Insurance) will be posted to you or your solicitor.

This map can then be submitted to the Property Registration Authority by your Solicitor for Registration

Maps purchased from Ordnance Survey or Land Registry Ireland do not have the individual property in question outlined but rather are maps of the general area in which the property is located. It is necessary for a qualified professional to then survey the site and after a review of the title maps to mark up the purchased map and identify the boundaries correctly, it is sometimes necessary to liaise with Ordnanace Survey Ireland to resolve discrepancies between the historical record and the OSI record. After the land has been surveyed, the surveyor will then mark up the OSI or Land Registry Map and will certify this based on the measurements taken. The most basic maps are for houses and cost ca €225+VAT, apartments are more expensive because of the requirement to produce floor plans in addition to the land registry compliant map. For Apartments or other multi storey units where another unit is located above or below the unit in question, it is necessary for the registration authorities to be able to identify the correct unit in the vertical as well as horizontal direction. To accomplish this The Property Registration Authority stipulates that in addition to the normal land registry compliant maps that scaled floor plans with the Ordnanace Survey Ireland coordinates both for horizontal and vertical directions must be included on the floor plans. To this end we must conduct a full measurement survey of the unit and produce the scaled floor plans in autocad format prior to including the OSI coordinates. Hence for multi storey units scaled floor plans with OSI coordinates and an accompanying Land Registry Map are required.

During the survey we will measure the land/property and produce land registry compliant maps and or lease maps as required. We will scan and email the completed maps to you and your solicitor with the original certified copy posted to your solicitor for lodging. If there are any anomalies between what is found on site and the OSI records we will seek to resolve these with OSI on your behalf.
